5-year limited warranty

The 5-year limited warranty from Pergolas Signature applies to the components of its products. It covers any manufacturing defect, aluminum included.

To benefit from it, the products must be installed by a technician authorised by the company. The warranty only takes effect from the date of installation.

It is offered to the original purchaser (the "Customer") only, and it is not transferable. It is limited to the price paid for the product.

The warranty includes the labour of authorised Pergolas Signature installers for one year, from the date the pergola is installed. It applies in Canada only.

Warranty exclusions

The warranty does not cover damage caused by an unforeseen event or by force majeure. This includes colour alteration caused by sun and salt, fire and vandalism.

Weather conditions outside the ordinary are covered by this exclusion too. For example: deep frost, high winds, heavy snow, lightning, heavy rain, freezing rain, hail, hurricanes, ground movement, flooding, the overflow of any watercourse.

The warranty does not cover damage resulting from an installation carried out by the customer or by a technician not authorised by Pergolas Signature. The same goes for damage resulting from improper winter preparation, poor maintenance or misuse, contrary to the instructions given by Pergolas Signature.

The warranty does not cover direct or indirect damage from the customer’s negligence. Nor does it cover damage from inadequate maintenance or misuse of the product.

Misuse includes exposure to a direct or indirect heat source. It also includes removals, modifications and/or additions made by the customer. It includes any weight load on the louvres and the structure.

The warranty does not cover direct or indirect damage resulting from the movement or breakage of the installation surface. That includes a concrete slab or any other surface on which the Pergolas Signature product is installed.

The warranty does not apply in the following cases:

Installations carried out by an unauthorised technician.
Assembly and correct operation of the components not carried out by an authorised Pergolas Signature installer.
Direct or indirect damage caused by the customer’s structure on which the product is installed.
Water run-off or infiltration between the wall and the pergola on an installation attached to a building.
Packaging, dismantling, storage, transport and handling costs.
Damage caused to the adjustable louvre walls by the wind.

Motorisation warranty

The motor, the lights and/or any electrical parts are warranted for three (3) years. That period starts when this warranty takes effect. It applies when they are purchased at the same time as the pergola.

Overdue account

If the customer or the reseller has unpaid debts towards Pergolas Signature, the warranty is suspended without notice and without delay. The suspension stays in place until the customer or the reseller has settled all outstanding debts. The settlement must be complete and satisfactory to Pergolas Signature.

Purchasing a replacement part does not extend the duration of the warranty.

Claim policy

To make a claim under this warranty, the customer sends written notice by email to Pergolas Signature at info@pergolassignature.ca. The customer has 30 days from the discovery of the defect.

The notice must include:

The customer’s name and address.
A detailed description of the defect.
Photos.
The installation date.
The date the defect was discovered.
The installation address.
The installer’s name.
The retailer’s address.
A copy of the invoice.

Pergolas Signature reserves the right to inspect the structure and the product before deciding whether the warranty applies. The customer must therefore avoid any repair or modification before the inspection. A repair or modification made before the inspection can void the warranty.

If the inspection confirms that the warranty applies, Pergolas Signature acts at its discretion. It may replace the defective product, repair it, or refund the amount the customer paid. It has 180 days from receiving the warranty claim.

The customer pays the labour costs incurred by Pergolas Signature more than one year after the installation date. If the product to be replaced is no longer available, it is replaced by a product of value equivalent to the original one.
